Our Commitment to Privacy. FUJIFILM Recording Media U.S.A., Inc. ("we", "us" or "Fujifilm") cares about your privacy. This Privacy Policy will help you better understand the online information practices that apply when you visit the FUJIFILM TapePower Center website at tapepower.fujifilmrmd.com (the "Program Site") and the choices you can make about the way your personally identifiable information is collected and used.

Consent. By accessing, browsing or otherwise using this Program Site, you consent to the collection, use, storage and disclosure of information as described in this Privacy Policy and the TapePower Membership Program Terms and Conditions and Terms of Use linked to the Program Site.

Scope. This Privacy Policy applies to personally identifiable information about individuals collected through the Program Site and does not apply to the information collected, used or disclosed with respect to corporate or commercial entities. This Privacy Policy does not impose any limits on our collection, use, storage or disclosure of information exempted under applicable privacy legislation, including business contact information and certain publicly available information.

Information We Collect. The information we learn from visitors to the Program Site helps us improve the Program Site and provide better service to you. The information we collect and store falls into two broad categories: (1) information you voluntarily provide to us and (2) information that is automatically collected.

Information you voluntarily provide to us.  While Fujifilm does not require that you provide personally identifiable information to visit the Program Site, we may collect and store personally identifiable information you voluntarily provide to us while on the Program Site. For example:

When you create a new account to participate as a Member of the Fujifilm TapePower Program, you will be required to provide certain personally identifiable information, including your legal name, company name, mailing address, email address, telephone number, and other information that may be necessary to establish your new Membership account. Fujifilm may use such information to assist you with your Membership account, provide information regarding Fujifilm’s TapePower Program, including announcements regarding changes affecting our product or service offerings, process your requests for MegaPoint Rewards, and notify you of changes to our Program terms and Program Site. If you choose not to provide this personally identifiable information when requested, you will not be able to participate in the TapePower Program and your Membership account, if any, may be deactivated.

When you enter a sweepstakes or contest, either through the Program Site or otherwise, we may ask you for your name, address, date of birth and e-mail address so that we can administer the sweepstakes or contest and notify the winners.

When you request newsletters, product information or a product brochure, or correspond with us via email, we may ask you to provide your e-mail address and any other information that is reasonable and necessary to communicate with you in response to your request.

We may also use your personally identifiable information to send you information regarding upcoming events, end user promotions, announcements regarding new Fujifilm products or services, or that is otherwise intended to promote Fujifilm products. If at any time you would like to stop receiving promotional information from Fujifilm, please notify us as provided in the "Contact Us" section below.

You can also cancel your Membership by notifying us as provided in the "Contact Us" section below. If you request cancellation of your account, Fujifilm may remove any and all of your information from the Program Site, which may not be accessible to you even if you choose to later reactivate your account or rejoin as a registered user. To comply with applicable laws, we may retain certain account information for a limited time. For example, we will keep personally identifiable information used to make a decision affecting you for at least one year after using it to make the decision, unless otherwise permitted or required by law. This data will be retained in a manner consistent with all of our other data and information retention policies.

Information Collected Automatically.  We also collect and store certain non-personal information that is generated automatically as you navigate through the Program Site, which may include your Internet Protocol address, browser and operating system descriptor, URL of referring webpage, preferences, likes and dislikes, and other information. Such non-personally identifiable data is collected for reporting about our Program Site usability, performance and effectiveness, and to improve customer experience, usability and Program Site content. Use of Cookies. Like many other companies, we use a standard feature found in browser software called a "cookie" that enables us to place bits of text on your hard drive for record-keeping purposes. By showing how and when visitors use our Program Site, cookies help us track user trends and patterns. They also relieve you from having to re-enter your preferences on certain areas of the Program Site where you have previously entered preference information. With Whom We Share Information. Except where restricted by applicable law, Fujifilm may, from time to time, share your personally identifiable information with its affiliated companies, professional advisors, government agencies and/or third party suppliers and service providers (such as website hosting companies, e-mail service providers, analytics companies, fulfillment companies, and other similar service providers that use such information on our behalf) to the extent necessary to fulfill a specific purpose. For example, we share your personally identifiable information with our third party TapePower Program coordinator to administer the Program Site, assist you with transactions requested by you and respond to your requests for MegaPoint Rewards, product information or account inquiries. In addition, we may disclose your personally identifiable information, with or without your consent, in the event of any corporate reorganization, merger or acquisition effecting Fujifilm’s or its affiliates’ business or assets, to enforce our TapePower Program Terms and Conditions and Terms of Use, or when we are required to do so (i) under applicable law or in connection with any legal proceeding, subpoena or court order, (ii) to prevent physical harm or property damage, or (iii) as part of an investigation of suspected or actual unlawful conduct.

Data Security. To protect your personally identifiable information against unauthorized access, maintain data accuracy, and ensure the correct use of information, we adopt all necessary and appropriate physical, electronic, and managerial procedures to safeguard and secure the personally identifiable information collected through the Program Site. Unfortunately, the transmission of information via the Internet is not completely secure. Despite our reasonable efforts, we cannot guarantee the security of your personally identifiable data transmitted to our Program Site; any transmission is at your own risk. Accordingly, we disclaim any liability for any theft or loss of, unauthorized access or damage to, or interception of any data or communications, by using this Program Site.

Your account with us, which contains your user-provided information, is accessible by you online, but it is protected by password. We strongly recommend that you do not give your password to anyone. We also recommend that you change or re-arrange your password every three months. If you are using a public computer (for example, at a library), or if it is a shared computer, we urge you to log out of your account and our Program Site altogether, and quit the browser application before you leave the computer. This may help to prevent others from accessing your account and any personal information.

Links to Third Party Websites. The Program Site may contain links to third party websites that are not under the control of or maintained by Fujifilm and Fujifilm is not responsible for the content, security, privacy policies or the operation of third party websites. Further, if you opt to engage in transactions on third party websites linked to the Program Site, such as purchases or promotions, we are not responsible or liable for any issues arising from or related to such transactions and you must deal with the third party operators of such websites if any issues arise. When visiting any third party website we suggest that you routinely review the applicable privacy policy or statement and other posted terms and conditions to understand your rights and options. The inclusion of any link to a third party website on the Program Site does not imply endorsement by Fujifilm of such third party website or any association with its operators.

Corrections. We recognize that there may be times when you want to access your account or modify your personally identifiable information. Accordingly, we invite you to contact us, as provided in the "Contact Us" section below.

Our Special Commitment to Children’s Privacy. Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information on our Program Site from users who we actually know to be under the age of 13 and no sections of our Program Site are structured to attract or solicit any person under this age.

Do Not Track. "Do Not Track" is a privacy preference that you can set in your Internet search browser that sends a signal to a Program Site that you do not want the Program Site operator to track certain browsing information about you. However, because our Program Site is not configured to detect Do Not Track signals from a user’s computer, we are unable to respond to Do Not Track requests at this time.

Changes to this Privacy Policy. Fujifilm reserves the right to change, amend, or update this Privacy Policy from time to time. Changes to our Privacy Policy will be posted to this Program Site and, where appropriate, notified to you by e-mail.
